The terms that govern use of our Site and Services.

These Terms & Conditions ("Terms") govern your access to and use of ridgepointoperations.com (the "Site") and the services offered by RidgePoint Operations LLC ("RidgePoint Operations," "we," "us," or "our"). By using the Site or opting in to our communications, you agree to these Terms. If you do not agree, do not use the Site or Services.
The Site and Services are intended for business users age 18 or older. You agree to use the Site only for lawful purposes and to provide accurate information when contacting us or submitting a form.
RidgePoint Operations provides missed-call text-back, SMS, and AI chatbot automation and related consulting Services to businesses. Specific deliverables, fees, and terms for paid engagements are set out in a separate written agreement between you and RidgePoint Operations. Nothing on the Site constitutes a binding offer to provide Services.
These SMS Terms apply to our text messaging program and are part of these Terms.
Program description. By submitting your phone number through a form on our Site and checking the SMS consent box, you consent to receive text messages from RidgePoint Operations. Messages may include responses to your inquiries, missed-call text-back replies, AI chatbot conversation replies, appointment and call confirmations and reminders, account and service notifications, and customer care messages.
Consent. Your consent to receive text messages is not a condition of purchasing any goods or Services.
Message frequency. Message frequency varies based on your interaction with us.
Costs. Message and data rates may apply. These charges are billed by and payable to your mobile carrier.
Opt-out. Reply STOP to cancel at any time. We will send a confirmation message and then stop sending texts.

Supported carriers. Carriers are not liable for delayed or undelivered messages. Delivery is subject to transmission by your mobile carrier and is not guaranteed. Supported carriers may change without notice.
Privacy. No mobile information, opt-in data, or consent will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.
The Services are tools that support your business; they do not guarantee any specific outcome, lead volume, response rate, revenue, or level of message deliverability. Message delivery depends on carriers, third-party platforms, and factors outside our control, and messages may be filtered, delayed, or blocked. You are responsible for the results you achieve using the Services.
Our Services include an automated AI chatbot. Its responses are generated by software, may be inaccurate or incomplete, and do not constitute professional advice or a binding commitment on behalf of RidgePoint Operations. You are responsible for reviewing automated communications before relying on them.
The Services rely on third-party platforms and providers (including, for example, telephony carriers, messaging and CRM platforms, and search and social platforms). We are not responsible for the availability, performance, acts, omissions, outages, or policy changes of any third party, and such events are not a breach of these Terms by us.
All content on the Site, including text, graphics, logos, and software, is owned by or licensed to RidgePoint Operations and protected by applicable law. You may not copy, reproduce, or distribute Site content without our prior written permission.
The Site, Services, and any information on them are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or Services will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, RidgePoint Operations will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to the Site or Services. Our total aggregate liability for any claim arising from or related to the Site or Services will not exceed the amount you paid to us for the Services in the six (6) months preceding the event giving rise to the claim, or one hundred dollars ($100) if you have paid nothing.
You agree to indemnify, defend, and hold harmless RidgePoint Operations and its owners, members, and contractors from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site or Services or your violation of these Terms or applicable law.
Any dispute arising from or relating to these Terms, the Site, or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable rules, seated in Wake County, North Carolina, rather than in court, except that either party may bring an individual claim in small-claims court. You and RidgePoint Operations waive any right to a jury trial and agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding. If this class-action waiver is found unenforceable, the arbitration provision will be void as to that dispute.
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. Subject to Section 11, the exclusive venue for any dispute not subject to arbitration is the state and federal courts located in Wake County, North Carolina.
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with any separate written agreement for paid Services, are the entire agreement between you and RidgePoint Operations. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a business transfer. We are not liable for any failure or delay caused by events beyond our reasonable control.
We may update these Terms from time to time. Changes are effective when posted, and continued use of the Site constitutes acceptance.
